【판시사항】
[1] 인터넷 링크를 하는 행위가 저작권법상 복제 및 전송에 해당하는지 여부(소극)
[2] 인터넷 이용자가 링크 부분을 클릭함으로써 저작권자에게서 이용 허락을 받지 아니한 저작물을 게시하거나 인터넷 이용자에게 그러한 저작물을 송신하는 등의 방법으로저작권자의 복제권이나 공중송신권을 침해하는 웹페이지 등에 직접 연결되는 경우, 링크 행위만으로 저작재산권 침해행위의 방조행위에 해당하는지 여부(소극)
【판결요지】
[1] 이른바 인터넷 링크(Internet link)는 인터넷에서 링크하고자 하는 웹페이지나, 웹사이트 등의 서버에 저장된 개개의 저작물 등의 웹 위치 정보나 경로를 나타낸 것에 불과하여, 비록 인터넷 이용자가 링크 부분을 클릭함으로써 링크된 웹페이지나 개개의 저작물에 직접 연결된다 하더라도 링크를 하는 행위는 저작권법이 규정하는 복제 및 전송에 해당하지
아니한다.
[2] 형법상 방조행위는 정범의 실행을 용이하게 하는 직접, 간접의 모든 행위를 가리키는데, 링크를 하는 행위 자체는 인터넷에서 링크하고자 하는 웹페이지 등의 위치 정보나 경로를 나타낸 것에 불과하여, 인터넷 이용자가 링크 부분을 클릭함으로써 저작권자에게서 이용 허락을 받지 아니한 저작물을 게시하거나 인터넷 이용자에게 그러한 저작물을 송신하는 등의
방법으로 저작권자의 복제권이나 공중송신권을 침해하는 웹페이지 등에 직접 연결된다고 하더라도 침해행위의 실행 자체를 용이하게 한다고 할 수는 없으므로, 이러한 링크 행위만으로는 저작재산권 침해행위의 방조행위에 해당한다고 볼 수 없다.
