Etape 1 : Les professions juridiques
Au Royaume-Uni
Outre-Manche, on distingue deux grandes catégories au sein des professions juridiques :
solicitors : conseils, notaires, huissiers de justice,
barristers : avocats ;
Vous leur paierez des honoraires (fees).
C'est parmi ces juristes que sont recrutés les juges : examining justice (juge d'instruction ), recorder (juge à temps partiel ), stipendiary justice (pour les juridictions inférieures ), puisne judge (à la Haute Cour de Justice ) ou encore Lord Justice of Appeal (à la cour d'appel ).
Aux Etats-Unis
Outre-Atlantique il n'existe pas la même distinction qu'en Grande-Bretagne entre conseil / notaire et avocat. Un lawyer (avocat au sens général du terme) peut être attorney / attorney-at-law (avocat ) ou counsel / counsellor / counsellor-at-law (conseil juridique ). Ils peuvent être indépendants (single practitioners) ou travailler au service juridique d'une entreprise (to work in the legal department of a firm).
Il est très courant aux Etats-Unis d'aller voir un avocat pour rédiger un acte juridique (a legal document).
Vous pourrez rencontrer tous ces hommes de loi :
Au Royaume-Uni dans un county court (tribunal de comté ) pour la justice civile (civil courts) ou dans un Magistrate court (tribunal de première instance ) pour le pénal (criminal courts).
Aux Etats-Unis dans un criminal court (tribunal de première instance ), un juvenile court (tribunal des mineurs ) ou un probate court (tribunal spécialisé dans les affaires de succession).
Au niveau fédéral, on retrouve la même hiérarchie de juridictions qu'au sein de chaque Etat, et notamment la Supreme Court (la Cour suprème ), composée de neuf Justices (juges de la Cour suprème ).
Dans les deux pays existent bien entendu des cours d'appel (court of appeal /appellate court). Step 1: The legal profession
UK
In the UK, there are two major categories within the legal profession:
Solicitors: advice, notaries, bailiffs,
Barristers: lawyers;
You pay their fees (fees).
It is among these lawyers that judges are recruited: Examining Justice (magistrate), recorder (part-time judge), stipendiary Justice (lower courts), puisne judge (the High Court) or Lord Justice of appeal (the court of appeal).
In the USA
Across the Atlantic there is not the same distinction in Britain between council / notary and lawyer. A lawyer (lawyer general sense) is attorney / attorney-at-law (lawyer) or counsel / counselor / counselor-at-law (legal advice). They can be independent (single Practitioners) or work in the legal department of a company (to work in the legal department of a firm).
It is very common in the United States to go to a lawyer to draft a legal act (a legal document).
You can meet all these lawyers:
In the UK in a county court (county court) for Civil Justice (civil courts) or in a short Magistrate (first instance) to the penal (criminal courts).
In the United States in a criminal court (trial court), a juvenile court (juvenile court) or a short probate (court specializing in inheritance cases).
At the federal level, we find the same hierarchy of jurisdictions and within each State, including the Supreme Court (the Supreme Court), composed of nine Justices (judges of the Supreme Court).
In both countries there are of course the courts (court of appeal / appellate court).
