Droit des Biens - Cours

TITRE 1 : LA DISTINCTION DES BIENS
Les biens ont chacun des traits distincts qui sont les raisons des règles propres à chaque bien : un immeuble, qui est fixe. De là découle des caractéristiques applicables à cette catégorie qu’elle est la seule à avoir.
Distinctions plus ou moins importantes/riches.
CHAPITRE 1 : LES CHOSES APPROPRIÉES ET LES CHOSES NON APPROPRIEES
Il y a des choses qui sont à la périphérie du Droit des Biens mais sont des biens potentiels, ou des anciens bien et marquent une évolution.
I- Les choses communes
Les choses communes sont les restes communistes du droit romain. Cette distinction vient du droit romain, et pour comprendre cette influence du droit romain, il faut avoir l’idée suivante : le droit romain se différencie du droit moderne français en ce que contrairement au droit français, le système est profondément objectiviste. Ce droit confère aux éléments du monde juridique des statuts, qui déclenchent un ensemble de pouvoir/ de règles. Donc, le droit romain exclus le droit objectif. Les choses communes sont régies par l’article 714 code civil « il y a des choses qui n’appartiennent à personne et droit l’usage est commun à tous » Il y a des choses communes qu’on a soustrait à l’appropriation afin d’en réserver l’usage à tous. La propriété est antithèse de la communauté. Ce qui est commun n’est pas propre, et inversement. TITLE 1: KINDS OF PROPERTY

CHAPTER 1: THE APPROPRIATE THINGS AND THINGS NOT APPROPRIATE
There are things that are on the periphery of Goods Law but are potential assets, or old well and mark an evolution.
I- common things
The common things are the communists remains of Roman law. This distinction comes from the Roman law, and to understand the influence of Roman law, you must have the following idea: Roman law differs from modern French law in that contrary to French law, the system is deeply objectivist. This law gives the elements of the legal world of the bylaws, which trigger a set of power / rules. So Roman law excluded the objective law. The common things are governed by Article 714 Civil Code "there are things that belong to nobody and right use is common to all" There are common things that we have withdrawn from ownership to to reserve the use at all. The property is antithetical to the community. What is common is not clean, and vice versa.
